Session Terms and Conditions
Effective date: 2019.01.01 · Applies to all online (Zoom) sessions hosted by Teringette.
By joining any Zoom session hosted by Teringette ("Host"), you ("Participant") agree to the following terms and conditions:
1. Recording and Use of Sessions
1.1. All Zoom sessions are recorded for quality assurance, training, and other business purposes.
1.2. By joining the session, you explicitly grant the Host full rights to use the recordings and all related materials, including but not limited to:
- Lesson plans, training materials, and educational content
- Code, scripts, or any technical contributions
- Advertising and promotional materials
- AI training and development
- Any other commercial or non-commercial use deemed appropriate by the Host
1.3. The Host retains all intellectual property rights over the recorded content, lesson plans, and materials, including any derivative works, regardless of contributions from Participants.
1.4. If you do not wish to be recorded or do not agree to these terms, you must refrain from joining the session.
2. Participant Consent, Payment, Use of Equipment, and Waiver
2.1. By participating in the session, you acknowledge that you have read and agreed to these terms and voluntarily grant all necessary rights to the Host without expecting compensation. You also agree to pay the session fee upon joining, as required by the Host.
2.2. You waive any claims, rights, or legal actions related to the use, modification, distribution, or display of the recordings and related materials.
2.3. By joining the session, you explicitly agree to use your camera, microphone, screen sharing, and remote control features when requested by the Host.
2.4. You acknowledge that all audio, video, and shared content may be recorded, and you consent to such recordings without restriction.
2.5. The Host assumes no liability for any damages, data loss, privacy breaches, or misuse of screen-sharing or remote control features.
3. Privacy and Data Protection
3.1. The Host will handle personal data in accordance with applicable privacy laws under Hungarian jurisdiction.
3.2. Participants should avoid sharing sensitive personal information during recorded sessions.
3.3. The Host is not responsible for any unauthorized access, sharing, or misuse of recordings by third parties.
4. Elimination of Liability and Full Legal Protection of Host
4.1. The Host assumes no responsibility for any damages, losses, or legal claims arising from participation in recorded Zoom sessions.
4.2. The Participant assumes full responsibility for their own statements and actions during the session.
4.3. The Host is not liable for any third-party use or distribution of the recorded content.
4.4. The Host shall not be responsible for any technical failures, disruptions, unauthorized access, data loss, or other issues that may arise from the use of Zoom or related technologies.
4.5. The Host disclaims any liability for indirect, incidental, consequential, or punitive damages that may occur due to participation in the sessions.
4.6. The Participant agrees to indemnify and hold the Host harmless from any claims, damages, or expenses arising from their participation, statements, or actions in the sessions.
4.7. The Host is not liable for any misinterpretation or misuse of the information shared during the session.
4.8. The Host is not responsible for any contractual disputes, misunderstandings, or disagreements that may arise between Participants as a result of their interactions during the session.
4.9. The Host is not liable for any damages resulting from third-party reliance on the information provided in the session.
4.10. The Host is not responsible for any breach of confidentiality or unauthorized sharing of information by Participants.
4.11. The Host is not liable for the consequences of any advice, recommendations, or opinions expressed during the session.
4.12. The Host is not responsible for refund requests, including but not limited to dissatisfaction with the session, inability to attend, or technical issues on the Participant’s end.
4.13. The Host is not liable for any unauthorized charges, disputed payments, or failed transactions related to the session fees.
4.14. The Host is not responsible for Participants failing to make full payment for sessions they attended.
4.15. The Host is not responsible for any unauthorized sharing, copying, or distribution of session content by Participants or third parties.
4.16. The Host shall not be held responsible for any claims related to intellectual property disputes, including claims that a Participant’s contribution was used without permission.
4.17. The Host is not responsible for any defamation, offensive content, or misconduct occurring in the session, whether by Participants or any other party.
4.18. The Host is not liable for any Participant experiencing technical difficulties, including but not limited to poor internet connection, hardware malfunctions, or inability to access the session.
4.19. The Host is not responsible for session cancellations, rescheduling, or any resulting inconvenience.
4.20. The Host shall not be liable for any force majeure events, including but not limited to natural disasters, internet outages, platform failures, or government actions preventing the session from proceeding.
4.21. The Host is not responsible for any third-party claims against Participants due to statements, actions, or materials shared during the session.
4.22. The Host is not responsible for any claims of harassment, discrimination, or misconduct between Participants.
4.23. The Host is not liable for any damages, financial losses, or reputational harm that may arise from Participants relying on session content.
4.24. The Host is not responsible for any withdrawal of consent by a Participant regarding AI training or content use after the session has been recorded and processed.
4.25. The Participant agrees that by joining the session, they release the Host from any and all legal claims, financial liabilities, or damages arising from any aspect of the session, its content, or its distribution.
5. Session Etiquette Rules
5.1. Participants must maintain a professional and respectful demeanor throughout the session.
5.2. Disruptive behavior, including excessive interruptions, offensive language, or harassment, is strictly prohibited.
5.3. Participants should keep their microphones muted when not speaking to minimize background noise.
5.4. The use of offensive, inappropriate, or misleading usernames, profile pictures, or backgrounds is not allowed.
5.5. Participants should avoid multitasking and remain engaged in the session to ensure a productive learning environment.
5.6. Unauthorized recording, screenshots, or sharing of session content by Participants is strictly prohibited.
5.7. The Host reserves the right to remove any Participant who violates these etiquette rules without refund or further participation rights.
6. Modifications to Terms
6.1. The Host reserves the right to amend these terms at any time without prior notice.
6.2. Continued participation in sessions after modifications constitutes acceptance of the updated terms.
7. Additional Legal Protections for Host
7.1. Indemnification Clause – Participants agree to indemnify, defend, and hold the Host harmless from any claims, liabilities, damages, losses, or expenses (including legal fees) resulting from their participation in the session.
7.2. Governing Language Clause – These terms shall be interpreted and enforced in the English language. Any translations are for convenience only and shall not be legally binding.
7.3. Third-Party Service Disclaimer – The Host uses third-party platforms such as Zoom and is not responsible for their functionality, security, or any breaches that may occur.
7.4. No Guarantee of Availability – The Host does not guarantee that sessions will always be available or uninterrupted and reserves the right to cancel or reschedule sessions at any time.
7.5. Right to Refuse Service – The Host reserves the right to deny or terminate access to any Participant at any time, without explanation or refund, if deemed necessary.
7.6. Data Storage and Retention Clause – The Host may retain session recordings for as long as necessary for business purposes and is not responsible for any loss or deletion of stored data.
7.7. Waiver of Class Action Lawsuits – Participants agree to resolve disputes on an individual basis and waive the right to participate in any class or collective action against the Host.
7.8. Mandatory Arbitration Clause – Any disputes must be resolved exclusively through binding arbitration in Hungary, rather than through court proceedings.
7.9. No Warranty Disclaimer – The Host provides all sessions, content, and materials "as-is" without any guarantees of accuracy, effectiveness, or fitness for a particular purpose.
7.10. Severability Clause – If any part of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
7.11. No Employment Relationship – Participation in sessions does not establish any employment, agency, or partnership relationship between Participants and the Host.
7.12. Limited Timeframe for Legal Claims – Any claims or disputes must be filed within 30 days of the event giving rise to the claim, or they are permanently barred.
7.13. No Reliance Clause – Participants acknowledge that session content is for informational purposes only and should not be relied upon for legal, medical, financial, or professional decisions.
7.14. Non-Transferability Clause – Participants may not transfer or assign their rights or obligations under these terms to any third party.
7.15. Age Restriction Clause – Only individuals aged 18 and above may participate in sessions. The Host assumes no responsibility for minors joining in violation of this rule.
7.16. Confidentiality Agreement – Participants agree to maintain the confidentiality of any sensitive or proprietary information shared during the session and not to disclose or distribute such information.
7.17. False Representation Disclaimer – The Host is not responsible for any misrepresentations made by Participants, including false credentials, expertise, or statements.
7.18. Independent Contractor Clause – The Host is an independent entity and does not act as an employee, representative, or agent of any Participant or organization.
Data Collection and Privacy
- The Host collects audio, video, chat, and any shared content during sessions.
- Purposes: quality assurance, training, AI development, marketing, and business use.
- Retention: recordings and materials may be retained as long as necessary for business purposes.
- Rights: Participants may request access, correction, deletion, or restriction of their personal data by contacting the Host at teringetteblog@gmail.com.
- Consent: By joining the session, Participants give explicit consent for data processing as described. Consent may be withdrawn at any time, but withdrawal does not affect the legality of prior processing.
- Third-party platforms: The Host uses Zoom and other third-party services; the Host is not responsible for their data security.
Limitation of Liability
- The Host is not liable for ordinary negligence, technical issues, or third-party misuse of session content.
- Liability cannot be waived for gross negligence, willful misconduct, or violations of mandatory law.
- Participants are responsible for their own devices, internet connection, and actions during sessions.
Age Restriction
- Only participants aged 18 or older may join sessions.
8. Governing Law and Dispute Resolution
8.1. These terms shall be governed by the laws of Hungary.
8.2. Any disputes arising under these terms shall be resolved through arbitration or mediation in Hungary.
By joining the Zoom session, you confirm your acceptance of these terms in full. If you do not agree, please do not participate.
